Dual Submission of CVs
Here at Oil Recruitment, we have noticed
a trend in the recruitment industry
where some less than scrupulous
recruiters are sending CVs to employers
without the candidate’s prior
permission. So what are the laws?

Recruiters are only permitted to send a
candidate’s CV to an employer upon
receipt of their express consent.
Failure to acquire this means they are
in breach of the Conduct of Employment
Agencies and Employment Business
Regulations, as well as Data Protection
laws.
I have received a CV for the same
candidate from two recruiters. Which
should I do business with?
The one who gets in first is not
necessarily the one to go with.
If you receive the same CV twice,
ask both agencies to provide evidence of
the candidate’s permission to send it.
The one who can provide this should be
the one you follow up with.
What should I do?

It is imperative in all cases that the
recruitment company gains the
candidate’s permission to send their CV
to a prospective employer. Should you
receive the same CV from an agency you
have instructed to work on your behalf,
and also one you have not, it is the
former you should follow up with,
regardless of who got in first. The
latter is not entitled to any fee,
providing you took no action as a result
of them sending you the CV. |

An employment agency has sent me a CV
out of the blue…
Should a recruiter send you a CV for a role
speculatively, having received no instruction
from you to act on their behalf, you are under
no obligation to do business with them. They are
only entitled to continue to do business if you
have expressly appointed them to act on your
behalf, and they have acted lawfully. If you are
sent a CV from an agency not working upon your
behalf and do wish to follow up on a candidate
whose details they have sent you, do not proceed
until you have agreed terms with the agency.
Who do I complain to if I think a
recruiter is in breach of this law?
If you feel a complaint is required, it can be
made to the Department of Trade & Industry’s
Employment Agency Standards Inspectorate.
